Filing your Colorado state income tax return

Figuring your Colorado state income tax is relatively simple, since a single flat tax rate is applied to all you taxable income. Also, Colorado made some tax credits unavailable, making your return even more simple.

For instance, starting in 2002, the state sales tax refund has been eliminated. In addition to discontinuing this refund, Colorado has also eliminated the following tax credits until further notice:

  • earned income credit
  • child tax credit
  • interest, dividend and capital gain subtraction
  • qualifying charitable contribution subtraction
  • health benefit plan credit
  • agriculture value added credit
  • family home care operators child tax credit
  • high technology scholarship contribution credit
  • individual development account contribution credit
  • foster care credit

Also, Colorado still allows a $20,000 pension/annuity exclusion for taxpayers who are at least 55 but not yet 65 years of age as of the last day of the tax year. For taxpayers who are at least 65 years of age, Colorado allows a $24,000 pension/annuity subtraction.

Keep in mind that retirement benefits are faxable to the state you are currently living in regardless of whether the source is outside the state.

Since Colorado does impose the flat tax rate, your capital gains are taxed at the same rate as the rest of your income.

Nonresidents of Colorado that earn income from a Colorado source, must file a Colorado state income tax return for the income earned.
